EXECUTIVE ORDER
NO95-05
WHEREAS, in recognition of the importance of energy efficiency and the use of clean, domestic energy resources, and of the importance of the leadership role of state government; and
WHEREAS, the Eighty-Sixth Missouri General Assembly enacted legislation during its First Regular Session to promote energy efficiency and the use of alternative fuels in state-owned vehicles (codified as Sections 414.400-414.417, RSMo 1994); and
WHEREAS, the statute provides for management of state fleets for efficient use of fuel, for acquisition of vehicles that will operate on alternative fuels, and for use of alternative transportation fuels in those vehicles; and
WHEREAS, the statute further provides that alternative fuel use should satisfy energy conservation and emissions goals (Sections 414.410.2 and 414.412.1(3), RSMo 1994);
NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, including Section 414.412.3, RSMo 1994, do hereby order that state agencies shall require each state-owned vehicle that does not operate on an alternative fuel to operate on a fuel ethanol blend as defined in Section 142.027, RSMo 1994, when available and competitively priced, in accordance with Section 414.412.3, RSMo 1994, providing:
- Competitive shall mean a price within five (5) percent of the cost of gasoline otherwise available;
- This order shall not apply in designated ozone nonattainment areas, including Jefferson, Franklin, St. Charles and St. Louis Counties and St. Louis City, from June 1 to August 31;
- This order shall not apply in designated ozone maintenance areas, including Jackson, Cass, Clay, Platte, Ray and Buchanan Counties, from June 1 to August 31;
- This does not restrict the use of commercially reformulated gasoline using ethanol (ETBE) as one of its components, nor of eighty-five (85) percent ethanol in vehicles equipped to operate on eighty-five (85) percent ethanol.
