EXECUTIVE ORDER
94-100
WHEREAS, Judith K. Moriarty, was elected Secretary of State, State of Missouri, on November 3, 1992, and sworn in as Secretary of State, State of Missouri, on January 11, 1993; and
WHEREAS, Judith K. Moriarty, as Secretary of State, State of Missouri, was charged with Misconduct in Office by and through three Articles of Impeachment issued by the Missouri House of Representatives on October 6, 1994; and
WHEREAS, I, Mel Carnahan, Governor of the State of Missouri, appointed Richard A. Hanson as Secretary of State on October 7, 1994, to serve until the impeachment of Judith K. Moriarty was determined, as provided for in Section 28.190, RSMo, 1986; and
WHEREAS, the Missouri Supreme Court on December 12, 1994, convicted Judith K. Moriarty of Misconduct in Office as charged in the Articles of Impeachment issued by the Missouri House of Representatives on October 6, 1994; and
WHEREAS, the result of said conviction is the removal of Judith K. Moriarty from the office of Secretary of State; and
WHEREAS, the term of Richard A. Hanson expired at the time said impeachment was determined; and
WHEREAS, Section 28.190, RSMo, 1986, provides that the governor shall take charge of the office until a permanent successor is appointed, commissioned and qualified;
NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, in charge of the office of Secretary of State, by virtue and authority of the powers vested in me by the Constitution and laws of the State of Missouri, and specifically those granted under Section 28.190, do hereby designate Richard A. Hanson as Deputy Secretary of State until such time that a permanent successor is appointed, commissioned and qualified to the position of Secretary of State and Mr. Hanson has had sufficient time to aid the new Secretary of State through a transition period.
