EXECUTIVE ORDER
93-50

WHEREAS, the Enforcement Section is an administrative unit of the Missouri Gaming Commission; and

WHEREAS, the Enforcement Section is charged by the Missouri Gaming Commission with the enforcement of Missouri statutes and administrative rules relating to riverboat gambling and bingo; and

WHEREAS, the function of the Enforcement Section is to investigate and prepare cases for both administrative and criminal prosecution which involve violations of Missouri riverboat gambling and bingo statutes; and

WHEREAS, the Enforcement Section is required to determine the moral character of individuals applying for riverboat gaming licenses and riverboat gaming suppliers' licenses; and

WHEREAS, the Enforcement Section may recommend refusal of a license to any person convicted of a felony or crime involving moral turpitude; and

WHEREAS, the Enforcement Section needs access to the National Crime Information Centers (NCIC) and the Missouri Uniform Law Enforcement System (MULES) computer data bases in order to execute its duties more efficiently; and

WHEREAS, the NCIC requires that the Governor designate the Enforcement Section of the Missouri Gaming Commission by Executive Order as a criminal justice agency before access to the aforementioned data bases can be authorized;

NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, do hereby designate the Enforcement Section of the Missouri Gaming Commission as a Criminal Justice Agency for the purpose of gaining access to the computerized data bases administered by the National Crime Information Center and the Missouri Uniform Law Enforcement System.
