EXECUTIVE ORDER
93-35
WHEREAS, flooding has recently caused severe damage and destruction in the central portion of the United States including Missouri; and
WHEREAS, bridges in some counties have been severely damaged by flooding and there are no alternative routes available for a school bus to transport school children to and from school until repairs are completed; and
WHEREAS, the Commissioner of Education, Missouri Department of Elementary and Secondary Education, has determined that circumstances exist which justify paying parents, school employees, and other school district approved individuals for temporarily transporting school children to and from school in their privately-owned motor vehicles; and
WHEREAS, drivers of privately-owned vehicles that otherwise do not transport school children are needed immediately to provide such transportation on temporary alternate routes when a bridge will not support the weight of a school bus so that their education program is not disrupted; and
WHEREAS, drivers of privately-owned motor vehicles who are paid by a school district to transport school children are required to obtain a school bus permit by Section 302.272, RSMo; and those drivers would be unduly burdened to temporarily meet the school bus permit requirement of Section 302.272, RSMo, for the short term of this emergency.
NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, including Section 44.100, RSMo, hereby exempt parents, school employees, and other school district approved individuals who, when requested by the Superintendent of a school district, temporarily transport school children as required by Section 167.231, RSMo, over temporary alternate routes to and from school when a bridge will not the support the weight of a school bus, from the requirement of having a school bus permit under Section 302.272, RSMo. The exemption granted in this order shall continue until October 31, 1993 unless terminated earlier by order.
