WHEREAS, the Special Investigations Section (SIS) is an administrative unit of the Division of Consumer Affairs (DCA) of the Missouri Department of Insurance (MDI); and
WHEREAS, SIS is charged by the DCA and MDI with the MDI's charge by state statute to enforce the provisions of the insurance laws relating to insurance professional license discipline and to insurance fraud; and
WHEREAS, the purpose of SIS is to investigate and prepare cases for both administrative and criminal prosecution which involve violations of insurance laws relating to insurance professional licenses and to insurance fraud, which are punishable as misdemeanor and felony crimes; and
WHEREAS, the SIS is the primary agency which investigates misappropriation and deception by insurance professional licensees and fraudulent insurance acts; and
WHEREAS, the MDI is required to determine the moral character of individuals applying for licenses as insurance agents, insurance brokers, bail bond agents and public adjustors; and
WHEREAS, the MDI may refuse to issue a license to any person convicted of a felony or crime involving moral turpitude; and
WHEREAS, the SIS needs access to the National Crime Information Center (NCIC) and the Missouri Uniform Law Enforcement System (MULES) computer databases in order to execute its duties as a criminal justice agency more efficiently; and
WHEREAS, the NCIC requires the Governor designate SIS by executive order as a criminal justice agency before access to the aforementioned databases are authorized;
NOW THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of Missouri, hereby designate the Special Investigations Section of the Division of Consumer Affairs of the Missouri Department of Insurance as a Criminal Justice Agency for the purpose of gaining access to the computerized data bases administered by the National Crime Information Center and the Missouri Uniform Law Enforcement System.
