WHEREAS, the Bureau of Narcotics and Dangerous Drugs (BNDD) is an administrative unit of the Missouri Department of Health; and
WHEREAS, BNDD is charged by state statute to enforce all provisions of the Comprehensive Drug Control Act of 1989; and
WHEREAS, the purpose of BNDD is to investigate and prepare cases for both administrative and criminal prosecution which involve violations of the Comprehensive Drug Control Act of 1989, which are punishable as felony crimes; and
WHEREAS, BNDD is the primary agency which investigates pharmaceutical drug diversion as well as monitors the sale and purchases for misuse, abuse and illegal sale; and
WHEREAS, investigators of BNDD constantly monitor for drug-seeking individuals who fraudulently obtain controlled substances for misuse, abuse and illegal sale; and
WHEREAS, the Department of Health is required to determine the moral character of the individuals applying for registration to prescribe, administer, dispense and store controlled substances and to handle listed chemicals; and
WHEREAS, the Department of Health is prohibited by statute from issuing a registration to any person who has within five years been convicted for any offense related to controlled substances; and
WHEREAS, BNDD needs access to the National Crime Information Center (NCIC) and the Missouri Uniform Law Enforcement System (MULES) computer databases so that as a criminal justice agency performing the administration of criminal justice, it shall be able to execute its duties as a criminal justice agency more efficiently; and
WHEREAS, the NCIC requires that the Governor recommend BNDD be designated by executive order as a criminal justice agency before access to the aforementioned databases are authorized;
NOW, THEREFORE I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the constitution and laws of the State of Missouri, do hereby designate the Bureau of Narcotics and Dangerous Drugs of the Missouri Department of Health as a Criminal Justice Agency for the purpose of gaining access to the computerized data base administered by the National Crime Information Center and the Missouri Uniformed Law Enforcement System.
