WHEREAS, Section 4 of Senate Bill Number 728, Acts of the 85th G.A. (1990), codified as Section 12.028, RSMo Cum. Supp. 1990, empowers the Governor to accept on behalf of the State of Missouri, retrocession of Federal Jurisdiction if offered by the appropriate Federal authority, and
WHEREAS, Section 5 of the Public Buildings Amendments of 1988 (Public Law 100-678), 102 Stat.4050, gives the General Services Administration (GSA) of the Federal government the authority to offer an assignment of jurisdiction for the administration of criminal, health and safety laws for property under their charge and control, and
WHEREAS, on August 3, 1990, GSA offered assignment of jurisdiction to the State of Missouri for the administration of Missouri criminal laws and health and safety laws; provided that such jurisdiction is to be concurrent with jurisdiction of the United States who will continue to administer Federal laws, and
WHEREAS, the offer of assignment and concurrent jurisdiction pertains to the following Federal properties including all buildings and grounds associated therewith:
- Federal Building and Courthouse, 339 Broadway, Cape Girardeau, Missouri
- Federal Building and Courthouse, 302 Joplin, Joplin, Missouri
- Federal Office Building, 911 Walnut, Kansas City, Missouri
- United States Courthouse, 811 Grand, Kansas City, Missouri
- Federal Building, 1222 Spruce Street, St. Louis, Missouri
- Old Post Office, 815 Olive Street, St. Louis, Missouri
NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, do accept the offer of assignment of concurrent jurisdiction with respect to the locations designated above:
This Executive Order shall become effective immediately upon its execution.
