EXECUTIVE ORDER
86-16

WHEREAS, the establishment and appointment of a State Advisory Council for Emergency Medical Services for the purpose of evaluating State Emergency Medical Service Programs is a criterion developed pursuant to Standard 11 of the National Highway Traffic Safety Act of 1966 by the United States Department of Transportation; and

WHEREAS, the Omnibus State Reorganization At of 1974 has authorized the Governor to create by Executive Order such councils a- may be necessary to receive funds and to make such adjustments or modifications in the assignment of agency programs or operations as may be necessary to conform with federal law or regulations to receive federal funds; and

WHEREAS, the State Advisory Council for Emergency Medical Services was created by Reorganization Plan 3 of 1983, Executive Order 83-3, on January 27, 1983; and

WHEREAS, certain changes are necessary and desirable in the composition of the Council.

NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, do hereby declare and direct that the "State Advisory Council on Emergency Medical Services" hereafter shall consist of eighteen members appointed by the Director of the Department of Health and assigned for administrative purposes to the Department of Health. Four of the members of the Council first appointed after the effective date of this Executive Order shall be appointed for a term expiring December 31, 1997. Six of the initial members of the Council shall be appointed for a term expiring December 31, 1988, and eight of the initial members of the Council shall be appointed for a term expiring December 31, 1989. At the expiration of these terms, each succeeding member shall be appointed for a term of three years.

Members appointed to the Council may include licensed practicing physicians with demonstrated interest in the area of emergency medical services and individuals from such other emergency medical fields and organizations as: fire protection organizations, communications interests, hospital administrators, the state ambulance associations, Emergency Care Nurses, Emergency Medical Technicians, Mobile Emergency Medical Technicians and consumers. The Superintendent of the Missouri State Highway Patrol or his designee shall represent statewide law enforcement and serve, ex-officio, on the Council. No specific number of appointees from any category is required. The appointments shall be made geographically disbursed throughout the state, so all areas of the state are adequately and fairly represented. The Director of the Department of Health shall designate the Chairman of the Council who shall serve at the Director's pleasure.

The State Advisory Council shall:

  1. Assist in developing with the Bureau of Emergency Medical Services and other agencies a state emergency medical service plan.
  2. Monitor, review and comment, not less than annually, to the Director of tile Department of Health, and appropriate state agencies on the implementation of the emergency medical services plan.
  3. Respond to requests from the Director of Health on matters that relate to special projects that effect the delivery of emergency medical services.
  4. Review and comment on any proposed rules relating to EMS being considered by the Department of Health.

This Executive Order shall be effective upon execution and shall supersede any and all Executive Orders pertaining to the same subject.
