EXECUTIVE ORDER
85-3
WHEREAS, the establishment of a State Advisory Council for Vocational Education to advise the State Board of Education in the development of a Vocational Education Plan for the evaluation of vocational education programs, services and activities and for other duties as required by federal law is required by Public Law 98-524 as a condition for certain federal funds; and
WHEREAS, the Missouri Constitution Article 4, Section 51, requires that all members of administrative boards and commissions appointed by the Governor shall be made only by and with the advice and consent of the Senate; and
WHEREAS, because the duties imposed by Public Law 98-524 on the State Advisory Council for Vocational Education involve administrative and executive functions including the expenditure of federal funds appropriated by the General Assembly, the members must be confirmed by the Missouri Senate; and
WHEREAS, Public Law 98-524 requires that the members of the advisory council be appointed by the Governor; and
WHEREAS, the Omnibus State Reorganization Act of 1974 authorizes the Governor to create by Executive Order such advisory councils as may be necessary to receive federal funds and to make such adjustments or modifications in the assignment of agencies, programs or operations as may be necessary to conform with federal law or regulations to receive federal funds;
NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, do hereby declare and direct that there is created the "State Advisory Council on Vocational Education" consisting of thirteen members with qualifications as required by Public Law 98-524, Section 112 (a), and the rules and regulations adopted by the Secretary of the United States Department of Health, Education and Welfare thereunder.
The State Advisory Council for Vocational Education is assigned, for administrative purposes, to the Department of Elementary and Secondary Education which may serve as fiscal agent for the Council. Members of the Council shall receive such compensation and reimbursement as is otherwise authorized by law in accordance with appropriations therefore.
The State Advisory Council for Vocational Education shall have all the powers, duties and responsibilities as provided in Public Law 98-524 in order to fully implement and carry out the provisions of the Vocational Education Act of 1963, as amended.
The members of said Council shall be appointed by the Governor with the advice and consent of the Senate and shall serve for a term of three years except that one-third of the membership of said Council shall be appointed for a term expiring April 1, 1986; one-third of the membership of said Council shall be appointed for a term expiring April 1, 1987; and one-third of the membership of said Council shall be appointed for a term expiring April 1, 1988. At the expiration of these terms, each member shall be appointed for a term of three years and may be reappointed for successive years. Any appointment to fill a vacancy shall be for the remainder of the unexpired term.
The Council shall select from among its membership a chairman and shall provide bylaws for the operating procedures except that the bylaws must provide for not less than one public meeting each year at which the public is given an opportunity to express its views concerning the vocational education program in Missouri.
This order is effective on April 1, 1985, on which date the current Council on Vocational Education is abolished. All records and personnel of the existing Council shall be transferred to the Council hereby created. The bylaws and resolution of the existing Council shall operate as the bylaws and resolutions of the Council hereby created on April 1, 1985, unless thereafter modified.
