PROCLAMATION
and
EXECUTIVE ORDER

WHEREAS, meteorological conditions exist which have caused extreme heat for a prolonged period throughout the state of Missouri, and
WHEREAS, these conditions have caused a drought in the state of Missouri, and
WHEREAS, these conditions are reasonably determined to be expected to last for at least one week and probably longer, and
WHEREAS, loss of life has occurred and the threat of loss of additional lives exists.
NOW THEREFORE I, JOSEPH P. TEASDALE, GOVERNOR OF THE STATE OF MISSOURI, with the powers granted to me by the Constitution and laws of the state of Missouri and those specifically authorized by the provisions of Chapters 26, 41 and 44 RSMo, 1978, do hereby, proclaim declare and direct the following:
- A state of disaster exists throughout the state of Missouri beyond the capability of local government which disaster has actually occurred and which threatens the health, safety and welfare of the people and the preservation of their property. This state of disaster is of such major proportions that I proclaim a state of emergency to exist throughout Missouri.
- A shortage of energy resources and problems in the distribution of energy resources have occurred and will continue to occur during the period of the state of emergency and disaster. The health, safety, and welfare and the economic well-being of the people of this state require the invocation of sections 26.400 to 26.420. Therefore, I proclaim an energy resource emergency to exist throughout Missouri.
Further, I, Joseph P. Teasdale, Governor, direct the following actions to be taken during the effective period of this order:
- The Director of the Department of Natural Resources, or his designee, shall require all energy suppliers to promptly furnish such information as may in his judgment reasonably be required to determine the extent of the resource shortage and the supply and distribution problems.
- The use of state equipment and personnel is hereby authorized during the effective period of this order to carry out the provisions hereof and the Directors of the Departments of Natural Resources, Social Services, Mental Health, Agriculture, Public Safety, the Commissioner of Administration and the Public Service Commission, or their designees, are hereby authorized and directed to use the personnel and equipment of their respective agencies to assist in carrying out the provisions of this order and accomplishing the purposes of this order.
- The Adjutant General, or his designee, shall call into active service such units of the Army and Air National Guard as may be necessary in support of state and local agencies to accomplish the following missions:
- Open, operate, and secure such facilities of the state as may be determined to provide such relief to citizens of this state to protect their health.
- Provide such transportation assistance as may, from time to time, be required to accomplish the purpose of this order.
- Take such other actions and provide such other assistance to state and local officials as may from time to time be directed or authorized by the Governor.
- All agencies acting under authority of or at the direction of this order shall coordinate their efforts through the office of the Governor.
- Within ten days after the termination of this order, all agencies shall report in full on their activities under the provisions of this order.
This order shall take effect immediately and shall remain in effect until terminated by order of the Governor except that the provisions of Section 3 shall terminate not later than thirty days from this date unless extended by the General Assembly in accordance with law.
