EXECUTIVE ORDER
NO. 93-29

WHEREAS, on or about July 9, 1993, I declared a flood emergency pursuant to my authority under Section 44.010, RSMo; and

WHEREAS, the Missouri Department of Health is charged by law with safeguarding the health of the people in the state and enforcing a variety of health related laws and regulations; and

WHEREAS, in order to respond promptly and effectively to the flood emergency and to expedite the clean-up and recovery, it is necessary to adjust Department of Health laws and regulations and allow a right of entry to all propertiesin the state by Department of Health staff, their designees and assignees who are federal, state or local governmental employees;

NOW, THEREFORE, I, Mel Carnahan, Governor of the State of Missouri, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, do hereby issue the following order:

The Director of the Missouri Department of Health is vested with full discretionary authority to temporarily waive or suspend any statute or regulation under her purview in order to best serve the interests of public health and safety during the flood emergency, clean-up and recovery periods. In addition, Department of health employees, their designees and assignees are empowered to enter properties in the state to assess health risks during the emergency, clean-up and recovery periods, where there is reasonable cause to believe that conditions exist, which were created by the flood and its aftermath, that endanger the public health. This order shall remain in effect during the duration of the flood emergency.

IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the Great Seal of the State of Missouri, in the City of Jefferson, on this 6th day of August, 1993.
