WHEREAS, the state of Missouri should pursue all possible avenues to secure proper funding for the education of our young people; and
WHEREAS, under Public Law 97-35, the Omnibus Education Reconciliation Act of 1981, federal funds are available to the state for a wide range of educational purposes; and
WHEREAS, this federal law requires that the application filed with the Secretary of Education provide for an advisory committee appointed by the Governor to consult actively and continually with the state educational agency; and
WHEREAS, Section 1.12 of the Reorganization Act of 1974 authorizes the Governor to create by Executive Order such advisory councils as may be required to conform with requirements to receive federal grants.
NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, Including Section 1.12 of the Reorganization Act of 1974, hereby create and establish the Education Block Grant Advisory Committee.
The Education Block Grant Advisory Committee shall consist of twenty-four (24) individuals appointed by the Governor, to be broadly representative of the educational interests in the general public in the state, including persons representative of (a) public and private elementary and secondary schoolchildren; (b) classroom teachers; (c) parents of elementary and secondary schoolchildren; (d) local boards of education; (e) local and regional school administrators (Including principals and superintendents); (f) institutions of higher education; and (g) the Missouri General Assembly. Each of the members appointed by the Governor shall serve a term of four years; provided, however, that of the members first appointed, six (6) shall serve a term of four years; six (6) a term of three years; six (6) a term of two years; and six (6) a term of one year. Members appointed from the General Assembly shall serve their term as a member of this Committee only so long as they remain members of the General Assembly.
The Education Block Grant Advisory Committee shall have those functions and duties outlined in the Omnibus Education Reconciliation Act of 1981, including advising the State Department of Elementary and Secondary Education on the allocation among authorized functions of funds reserved for state use under Section 20 USC Section 3815, on the formula for the allocation of funds to local educational agencies, and on the planning, development, support, implementation, and evaluation of state programs assisted under said Chapter.
The Education Block Grant Advisory Committee is assigned for administrative purposes to the Department of Elementary and Secondary Education, which shall provide any staff assistance required by the Committee. Members of this advisory committee shall receive no compensation for their service to the state, but shall be reimbursed for their actual and necessary expenses from the appropriations made to the Department of Elementary and Secondary Education.
The Education Block Grant Advisory Committee annually shall make a report on its activities to the Commissioner of Education. A copy of that report shall be transmitted by the Advisory Committee to the Governor and to the legislative library.
