WHEREAS, Missouri`s Child Support Enforcement Program has been an important and integral component of the state's responsibility to the family, and,
WHEREAS, changes in the law and society may necessitate changes in the structure or function of the state's Child Support Enforcement Program; and,
WHEREAS, it is vital that the state work with, and coordinate its activities with, all aspects of government and society dealing with child support enforcement, and,
WHEREAS, it is desirable and necessary that the operation and efficiency of Missouri's Child Support Enforcement Program be continuously reviewed,
NOW, THEREFORE, I, JOHN ASHCROFT, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and laws of the State of Missouri, hereby establish the Missouri Child Support Enforcement Commission. The Commission shall be composed of twenty (20) members, sixteen (16) of whom shall be appointed by the Governor, with five (5) being representatives of governmental agencies having responsibility in the area of child support enforcement, four (4) of those sixteen (16) being representatives of the judiciary in the State of Missouri, three (3) being representatives of child welfare and social service agencies, two (2) being representatives of prosecuting attorneys in the State of Missouri, one (1) being a representative of the interests of custodial parents, and one (1) being a representative of the interests of noncustodial parents. In addition thereto there shall be two (2) members who are members of the House of Representatives, appointed by the Speaker of the Missouri House of Representatives and two (2) members who are members of the Missouri Senate, appointed by the President Pro Tem of the Missouri Senate.
The Director of the Department of Social Services shall designate one (1) of the members of the Commission to serve as Chairman, and the Chairman shall call meetings of tie Commission. The reasonable and necessary expenses of the Commission shall be paid by the Department of Social Services, and the Department of Social Services also shall provide such staff assistance as is required by the Commission, all as determined by the Department Director or his designee.
The duties of the Commission shall be to examine, investigate, and study the operation of the State's child support system for the primary purpose of determining the extent to which such system has been successful in securing support and parental involvement both for children who are eligible for aid under a state IV-A or D Plan and for children who are not eligible for such aid, giving particular attention to such specific problems (among others) as visitation, the establishment of appropriate objective standards for support, the enforcement of interstate obligations, the availability, cost and effectiveness of services both to children who are eligible for such aid and to children who are not, and the need for additional state or federal legislation to obtain support for all children.
The Commission shall submit to the Governor and make available to the public, no later than October 1, 1985, a full and complete report of its findings and recommendations resulting from its examination, investigation, and study under this Order.
The Missouri Child Support Enforcement Commission shall cease to exist on October 1, 1985, unless extended by Executive Order of the Governor executed prior to that date. Individual members of the Commission shall serve at the pleasure of the Governor.
